Justice Department limits False Claims Act cases built on agency guidance
Issue
The Justice Department revised its Justice Manual on September 18, 2026, so False Claims Act cases rest only on binding statutes, regulations or contracts. The change revives a 2017 policy and tells its lawyers to weigh dismissing whistleblower suits the department declines to join.
