Twenty-one attorneys general sue CMS over its youth gender-care funding rule
Issue
On September 2, 2026, 21 attorneys general and Pennsylvania's governor sued HHS and CMS over the rule ending federal Medicaid and CHIP payment for gender-dysphoria care for young people. It covers patients under 18 in Medicaid and under 19 in CHIP.
The states argue Congress never gave CMS that power.
