Judge lets NACHC defend the 340B patient definition in AbbVie's lawsuit
Issue
On August 24, 2026, Judge Randolph Moss let NACHC, Ryan White Clinics for 340B Access and 340B Health join AbbVie's lawsuit over HRSA's 340B patient definition. NACHC and RWC-340B also joined the government's motion to dismiss.
The court found AbbVie's narrower definition, if used in future audits, would bring real costs to their members.
